Whether or not the selected type of activity is subject to licensing.

During the period of self-isolation, we began to receive questions from jewelry stores about the transition to distance selling of jewelry . Therefore, we decided to remind you of the rules for online jewelry trading.

On December 12, 2022, Decree of the Government of the Russian Federation of November 30, 2022 No. 1542 “On Amendments to the Rules for the Sale of Goods by Remote Method” came into force, according to which the sale of jewelry made of precious metals and (or) precious stones is allowed on the territory of the Russian Federation , certified cut gemstones using a remote method, taking into account the features established by the legislation of the Russian Federation.

To open an online jewelry store, it is enough to have in the Unified State Register of Legal Entities or Unified State Register of Individual Entrepreneurs the activity code 47.77.2 “Retail trade in jewelry in specialized stores” and, of course, this OKVED must be declared in paragraph 7 of the special registration card in accordance with the order of the Ministry of Finance of Russia dated 01.02. 2016 No. 5n “On approval of document forms required for special registration of legal entities or individual entrepreneurs carrying out transactions with precious metals and precious stones.”

After allowing the activities of online jewelry stores, the well-known search engine Yandex lifted its restrictions on advertising of such stores in Yandex.Direct and Yandex.Market.

But Yandex reminds that stores that sell jewelry in Russia are required by law to have a certificate (notification) of special registration with the Assay Office.

Later in February 2022, the Federal Service for Surveillance on Consumer Rights Protection and Human Welfare published an information letter for jewelry buyers. In which it is reported that the sale of jewelry and other products made of precious metals produced in the Russian Federation, imported into its territory, subject to hallmarking in the manner established by the legislation of the Russian Federation, is carried out only if there are imprints of state hallmarks on them, as well as imprints of names ( for domestically produced products).

Without an imprint of the state hallmark, only the sale of jewelry and other domestically produced silver products weighing up to 3 grams inclusive (excluding inserts) is allowed.

If a product contains natural diamonds or emeralds, then the sale of such products can only be carried out if there is a certificate for each such stone or set (batch). Any buyer has the right to ask the seller to present such a certificate for review.

The seller of jewelry is obliged to provide the buyer with the following information:

  • address and brand name of the product manufacturer;
  • warranty period (if established), as well as expiration date;

Rospotrebnadzor especially pays attention to the purchase of goods with a shortage or used goods, for example, the purchase of jewelry in pawn shops. In addition to the above information, the seller is obliged to notify the buyer in writing of any defects in the product or that the product has previously been used. This information must be written on the sales receipt, on the label or in any other documents that are given to the buyer along with the precious product.

The seller is also obliged to familiarize the buyer with the shipping documentation for any piece of jewelry or precious stones that the buyer plans to purchase.

Jewelry and other products made of precious metals and (or) precious stones must always have individual packaging, imprints of the state hallmark and name tags (for domestically produced products), as well as seals without any defects and labels. The labels must contain information about the type of precious metal, article number, sample, weight, type and characteristics of inserts, including processing methods that changed the quality, color and cost characteristics of the precious stone, as well as the price of the product (prices for 1 gram of product without inserts ).

When using materials of artificial origin as inserts, the labels must indicate information that the stone is not precious.

If the cash register receipt for a product does not contain the name of the product, sample, type and characteristics of the precious stone, article number, along with the product, the buyer must be given a sales receipt indicating this information: seller, date of sale and price of the product. The person directly selling the goods affixes a signature.

If the jewelry is of good quality, but the size does not suit the buyer or the buyer no longer likes it, it will not be possible to return it or exchange it for a similar one.
