Legally, the term “license for jewelry” does not exist; there is a certificate of special registration with the Russian State Assay Office under the Ministry of Finance of the Russian Federation. According to the Federal Law of September 25, 1998 No. 158-FZ “On licensing of certain types of activities”, the Federal Law of March 26, 1998 No. 41-FZ “On precious metals and precious stones”, the Government Decree of the Russian Federation of May 21, 2001 No. 398 “On approval Regulations on licensing activities for the production and repair of jewelry”, a certificate must be obtained by all legal entities and individual entrepreneurs engaged in trading or processing of products made of precious metals and stones, except in cases of using diamonds in tools or in case of payment, but not receiving precious metals and stones in physical form, i.e. when placing paid precious metals on impersonal metal accounts.

Types of activities for which a certificate must be obtained

  • Wholesale and retail trade of jewelry and precious stones
  • Gemstone cutting
  • Production of precious stones and jewelry
  • Storage and sale of precious metals and stones, as well as jewelry
  • Pawnshop activity.

A jewelry license is issued by the State Assay Supervision Inspectorate (GISP) through the state Assay Supervision Inspectorates at the location of the organization. In St. Petersburg this is the North-Western State Assay Supervision Inspectorate.

The federal government institution, the Russian State Assay Chamber under the Ministry of Finance of the Russian Federation, in accordance with the Charter, exercises federal assay supervision and state control over the export from the Russian Federation to countries not included in the Customs Union, and the import into the Russian Federation from these countries of precious metals and precious stones , as well as control over the compliance of organizations engaged in the purchase, purchase and sale of precious metals and precious stones, jewelry made from them and scrap of such products, with the requirements of the legislation of the Russian Federation on combating the legalization (laundering) of proceeds from crime and the financing of terrorism.

In the process of issuing a jewelry license, the Federal Treasury Institution of the Russian State Assay Chamber under the Ministry of Finance of the Russian Federation does not carry out on-site inspections, but other government bodies have the right to check the premises for compliance with licensing requirements.

Legal entities and individual entrepreneurs are subject to special registration within 15 calendar days from the date of their state registration or making appropriate changes to their constituent documents in accordance with Decree of the Government of the Russian Federation dated October 1, 2015 No. 1052.

Legal entities and individual entrepreneurs carrying out transactions with precious metals and precious stones are subject to special registration, with the exception of:

  • credit organizations (banks);
  • organizations that use chemical compounds of precious metals in their activities for analysis;
  • organizations engaged in the purchase and sale and (or) use of finished forms of pharmaceutical, perfume and cosmetic products containing chemical compounds of precious metals;
  • educational organizations that use chemical compounds of precious metals in their activities when carrying out educational processes;
  • organizations engaged in the purchase and sale and (or) use of silver-containing photographic plates, photographic and film films, photographic paper and other photosensitive photographic materials;
  • organizations engaged in the purchase and sale and (or) use of paint and varnish products containing precious metals;
  • medical organizations that carry out reinforcement with threads made of precious metals, install implants, artificial teeth, dentures, prosthetic devices, as well as use dental cements and other dental filling materials containing precious metals or made from them;
  • organizations using machinery and equipment, instruments, instruments, electronic equipment, ballasts and automation devices, electrical devices, components, units containing precious metals, with the exception of organizations using glass melting devices, crucibles, catalysts made from precious metals and their alloys grids, laboratory glassware;
  • organizations that use chemical compounds, alloys, solders containing precious metals for the repair of machinery and equipment, instruments, tools, electronic equipment, ballasts and automation devices, electrical devices;
  • organizations that purchase and sell and (or) use in their activities tools and (or) products for industrial and technical purposes containing natural diamonds.

If all necessary procedures are completed, the applicant receives not only a certificate of special registration, but also a notification of special registration certified by the inspection. The notice is issued indefinitely. The territory of validity of the jewelry certificate is the region where the applicant applied to the inspection.

A certificate of special registration with the Russian State Assay Chamber under the Ministry of Finance of the Russian Federation allows you to:

  • wholesale and/or retail trade in precious metals and jewelry;
  • cutting of precious stones;
  • production of jewelry and precious metals;
  • pawnshop activities;
  • storage of precious stones, metals and jewelry;
  • production (minting) of commemorative coins and awards from precious metals.

Legal features of a pawnshop

Registration of a legal entity to open a pawnshop is the same as for any other limited liability company, but there are still some nuances.

1. The company name of the pawnshop must indicate the word “pawnshop” and its organizational and legal form. For example, like this: “Limited liability company Pawnshop “Golden Key”.

2. A pawnshop cannot be registered in an apartment. The law requires not only the creation of special conditions at the legal address for the storage and security of the surrendered property, but also the absence of other things not related to this business in the pawnshop.

3. A pawnshop has access to only three types of business activities, specified in the Law “On Pawnshops” No. 196-FZ:

  • provision of short-term loans to citizens (OKVED code 64.92.6: Activities for provision of short-term loans by pawnshops secured by movable property);
  • storage of things (OKVED code 66.19.5: Provision of services for the storage of valuables, depository activities);
  • consulting and information services (OKVED code 70.22: Consulting on commercial activities and management).

4. The pawnshop has no right to dispose of and use the pawned items. Pledged property that is not redeemed on time must be sold at public auction. This condition is mandatory for items costing more than 300,000 rubles. A pawnshop can sell less valuable items both through auctions and through other channels. In particular, you can open a consignment store to transfer pledged items for sale, but for this you need to register another LLC or individual entrepreneur.

5. The founder or participant of a pawnshop cannot be an individual who has an unexpunged (unexpunged) conviction for an economic crime or a crime against government.

6. The minimum authorized capital for a pawnshop in 2022 remained at 10,000 rubles, although bills were introduced proposing to increase it to 50 million rubles.

7. The law does not establish special requirements for premises specifically for a pawnshop, but the conditions of the so-called guiding document of the Ministry of Internal Affairs of the Russian Federation (RD 78.36.003-2002) must be observed. Without this, the security organization will not issue a certificate of compliance of the premises for pawnshop activities.

8. A license is not required for a pawnshop, but the organization will be under the constant control of Rosfinmonitoring, the Central Bank of the Russian Federation and the Assay Office, where you must register.

Organizations that the Bank of Russia included in the state register have pawnshop status. If a pawnshop is excluded from the register, the legal entity will lose the right to pawnshop status.

There are also requirements for the premises and employees:

  • an iron door to the room where jewelry is stored;
  • cash register that meets the requirements approved on January 1, 2017;
  • alarm with inspection reports;
  • documents confirming the presence of qualified employees on staff (if we are talking about the processing of precious stones and metals);

Carrying out jewelry trade without a certificate of special registration with the Assay Supervision Inspectorate is considered illegal on the territory of the Russian Federation and is punishable in accordance with the Criminal Code with confiscation of jewelry and profits received as a result of the activity.

Registration of a pawnshop with the Central Bank

As such, there is no special procedure for registering a pawnshop with the Central Bank of the Russian Federation, but the regulator automatically registers pawnshops because they must constantly report during their activities.
