After all, it would seem that there is nothing reprehensible in a person’s desire to make money from a treasure that has fallen into his hands, and it cannot be called theft...

“The fact is that a resident of the Amur region did not find gold in the form of coins or jewelry. It was schlich gold in the form of grains of different sizes. It turns out that this metal was extracted from the earth, and all natural resources that are not put into civil circulation belong to the state,” explains lawyer Alexander Prudnikov, who also specializes in the problems of “treasures.”

According to Prudnikov, gold is introduced into civil circulation after specialized enterprises or miners hand it over to the state for processing. Ingots are made from it, which are subsequently transferred either to jewelry factories, or used to make coins and other things. If a resident of the Amur region had found a jar of coins or any other gold in a processed form, it would have been a completely different situation, and he would not have been subject to criminal charges.

“What is the social danger of such an act as the sale of raw gold is a mystery shrouded in darkness. You can sell gold coins or jewelry, but you cannot sell yellow metal mined from the ground, although it is not clear what the damage from such an action would be for the state,” complains treasure hunter Vladimir Poryvaev.

Where do treasures go?

So, where to take the found valuables? If a gold nugget is found not on one’s own territory, then the law is inexorable: what is found will have to be given away for the good of the country. However, you will not receive immediate compensation for the find. Do you like to stand in lines and sign dozens of others to get one paper? And what awaits you:

The expert claims: a resident of the Amur region who found a jar of gold could avoid punishment. To do this, he had to inform the police and local authorities about his discovery. They could qualify it either as a treasure or as a find. The treasure has historical and cultural value; these are things that were hidden on purpose, and for quite a long time. The one who found the treasure is entitled to 50 percent of the value of the treasure. The remaining 50 percent goes to the land owner. If experts qualified the jar of gold as a find, then a resident of the Amur region would have to wait for its owner to appear for eight months. And only if he had not shown up would the gold officially find its owner. However, according to Poryvaev, there were virtually no such cases in the modern history of Russia.

Places where searching is strictly prohibited

I would not prohibit free mining of the yellow metal, but on the contrary, I would make sure that people invest more in it. Can I take the treasure for myself?

According to the law of the Civil Code of the Russian Federation, Article 233, a person has the right to keep everything in the following cases:

  • if you have discovered funds that are currently in circulation and made of ordinary metal;
  • jewelry of a modern brand (perhaps they accidentally fell out of someone’s hands; in this case, you can take them to the lost property office, the police, or keep them for yourself);
